Front Lift Bins – Terms and Conditions
1. TERMS OF HIRE
a. Service Days and Times
Meluca Big Bins will perform the Services, at the locations (Customer Site Address) and at the frequency, identified overleaf and if specified on the days agreed.
b. Waste Types
b.1. Allowable Waste: The Customer will only dispose of material permitted under the terms of this agreement, any variation to the agreed waste going into the bin may affect the price agreement and result in a change to future invoices. Any changes will be notified in writing to the Customer with 30 days notice.
b.2. Prohibited Waste: The Customer agrees not to dispose of any heavy or prohibited waste, including bricks, dirt, concrete, cement sheeting, asbestos, liquid paint, oils, chemicals, tyres, gas cylinders, batteries, hazardous, bio waste, syringes, or any prescribed waste into the skip bins. Violation of this clause may lead to penalties and/or additional fees assessed by the Company. The Customer Must notify Meluca Big Bins of any contaminated items to be going into the bins in writing prior to placing in the bin/s.
c. Filling Guidelines
c.1. Overfilling: Bins are to be filled level with the sides of the bin. Lids must be able to close without excessive force being required. Overfilling may result in additional charges or refusal of pick-up until the bin’s load is corrected.
c.2. Hand Loading: Bin/s are to be hand loaded only. No use of machines to fill the bins is allowed.
d. Damages
If a bin is severely damaged whilst on site, the Customer may be liable for the cost to repair or replace the bin. If your bin does not include castor wheels, any movement or relocation of the bin must be performed by the Company. If the bin needs to be moved, please contact the Company. Attempted movement by the Customer may cause damage to the bin and result in additional fees.
e. Missed Service
In the event that Meluca Big Bins is unable to perform the Services at the Customers Premises on the day/s agreed through no fault of Meluca Big Bins, a charge of 50% of the agreed service price will be charged to the Customer. This includes Meluca Big Bins being unable to gain access to the bin due to locked gates, items blocking access to the bin, animals at large and bin lid/s being locked on arrival etc.
f. Ground Surfaces
The Customer warrants the ground surfaces travelled on by Meluca Big Bins and that they are suitable for this purpose. The Customer acknowledges that Meluca Big Bins will not be liable for any damage to the ground surface resulting except in a case of gross negligence by Meluca Big Bins.
g. Ownership
The Customer acknowledges that unless purchased through a separate agreement, all equipment always remains the property of Meluca Big Bins.
h. Change of Address
If the Customer notifies Meluca Big Bins of a change of address for the bin/s on site, this agreement will remain in effect at the new address and Meluca Big Bins will transport the equipment at its expense to the Customer new address.
2. PAYMENT
a. Credit Terms
Full payment for services must be made within 14 days of the invoice date. Monthly Invoices will be sent on the 1st of each month or the closest Monday if the 1st falls on a weekend. Any additional fees incurred during the service period may be billed separately and are also due within 14 days of the invoice date.
b. Price Validity
The quoted prices are valid for 12 months from the date of this Agreement. After the expiration of this period, prices may be subject to an increase to reflect CPI increases. The Customer will be notified in writing by Meluca Big Bins, with 30 days notice given, of any change to the quoted price. After the initial 12 month term, the Service Agreement will then continue month by month until either party chooses to cancel the agreement. On cancellation of the Agreement, 30 days notice are to be given to the other party.
3. DEFAULT
If the Customer fails to comply with any provision of this Agreement, the Company may declare the Customer in default and, at its option, terminate this Agreement.
4. LIABILITY
The Customer agrees to assume liability for all loss or damage resulting from any misuse of the Company’s services, including but not limited to damage to the bin, lids, property, and disposal of prohibited materials.
5. ENTIRE AGREEMENT
This Agreement constitutes the entire Agreement between the Customer and Meluca Big Bins and supersedes any prior understanding or representation of any kind preceding the date of this Agreement.
